Terms & Conditions for Mind the Gap Online Courses & Services
These terms & conditions apply to anyone starting a course or purchasing a service with “Mind the Gap” and ‘Sarah Knight’ (Brand Name). These terms and conditions are a contract between you (student) and Mind The Gap. Mind The Gap is the training academy of Mash Communications (UK) Ltd.
The Terms and Conditions set out below and our Privacy Policy together constitute the legal agreement between you and Mind The Gap relating to the provision of training courses.
All online courses are provided by Mash Communications (UK) Ltd under the brand name “Mind The Gap”, registered business address 82 The Greenhouse, MediaCityUK, Salford, M50 2EQ; registered number: 08018568 (England and Wales)
Mind The Gap is the training academy of Mash Communications (UK) Ltd. The company name will be referred to as “Mind The Gap” herewith.
All intellectual property rights, including copyright in all content and communication belongs to Mind The Gap. By reading the Terms of Use you are agreeing that the content and property of Mind The Gap cannot be copied, reproduced, modified, stored, redistributed or exploited commercially in any way without permission from Mind The Gap.
Terms of Use
Mind The Gap / Sarah Knight Consultancy may change the content, which includes prices, offers and content at any time. We do not provide a warranty or guarantee of its accuracy, completeness, suitability, timeliness or performance of information or content in the website. If there are errors in the information provided in the content of the website we expressly exclude liability for these inaccuracies, to the fullest extent that the law permits.
You can use any of the information or content at your own risk for which Mind The Gap / Sarah Knight Consultancy will not be liable. It will be your responsibility to ensure that any products you purchase are suitable to your current requirements.
Acceptance of booking and invoicing
Mind The Gap has the right to not accept a booking.
If a booking request is made using the Mind The Gap / Sarah Knight Consultancy website or associated Mind The Gap course websites powered by Thinkific, you will receive an automatic email confirming we have received your booking request. All bookings are subject to availability.
By booking and starting a course or service with Mind The Gap you (the student) confirms that you meet the following minimum requirements of the course:
- All students must be 18 years old at the time of booking
- All students must have a competent level of English to study the courses as all courses are presented in English
By making a booking with Mind The Gap/ Sarah Knight Consultancy it is assumed the student satisfies the above conditions. The student, by making a booking, takes full responsibility in determining whether the course is suitable for their own level in English.
Course fee and payment
The fee to attend a course must be paid in full on booking before the start of the course, programme or service. Any payment plans are binding and agreed payment schedules at the point of purchase must be made.
Mind The Gap / Sarah Knight Consultancy has the right to refuse an attendee entry to the course if the course fee is not paid before commencement of the course or service.
All prices that are advertised on our website and promotional literature are correct at the time of booking. Mind The Gap / Sarah Knight Consultancy reserves the right and discretion to change and amend our prices at any time. Please check the website for the latest offers before you purchase. Once a course or service is purchased, the cost will immediately be charged.
Cancellations/Refunds
Cooling off Period:
Under the Consumer Protection (Distance Selling) Regulation 2000 you the consumer have the legal right to cancel the contract between you and Mind The Gap / Sarah Knight Consultancy during the period of 12 hours from date of purchase providing none of the course literature has been downloaded and none of the course undertaken. Should any aspects of the course have been downloaded it is 100% non-refundable.
This is known as the “cooling off period”. If you decide to cancel the course within this cooling off period then you must inform us within the 12 hours of the confirmation of booking the course. Once we receive your written cancellation, in form of an email we will refund your course fees within 30 days.
Once you have completed the cooling off period of 12 hours you will be under the full cancellation conditions of courses which are 100% non-refundable.
Cancelled courses
Mind The Gap / Sarah Knight Consultancy has the right to cancel a course. In this event Mind The Gap / Sarah Knight Consultancy will reimburse in full any course fees paid and Mind The Gap’s liability will be limited to the value of the course fees paid.
Limitation of Liability
Mind The Gap does not accept any liability for any loss or additional expense caused by delay or disruption to travel services, weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness or force majeure. Such losses or additional expenses are your responsibility. Force majeure represents unusual or unforeseeable circumstances, which include: war, terrorist activities, riots, natural disasters or nuclear disasters such as fire, flood or adverse weather conditions.
Complaints
If at any time, you are unhappy with the Mind The Gap service then please contact us immediately at sarah@mindthegap.academy and we will endeavour to respond as quickly as possible but no more than 30 days following the receipt of your complaint.
Personal data
Any personal data supplied by the customer can be processed by Mind The Gap on the legal bases and for the purposes set out in the Privacy Policy, which is freely available here www.mindthegap.academy
The Law and its Jurisdiction
These terms and conditions and any dispute or claim arising out of and in connection with them or their subject matter (including no contractual disputes or claims) shall be governed by and shall be construed in accordance with English Law and the Courts of England and Wales shall have exclusive jurisdiction over any claim arising out of it.
Changes to Terms and Conditions
Mind The Gap / Sarah Knight Consultancy reserves the right to change any of these conditions at any time deemed necessary to reflect current market and economic conditions.
The Course
The Course and the relevant login details are solely for your use. Another party cannot use these details.
Acceptance of these terms and conditions
By reading these terms and conditions or making payment on the website for a selected course you are accepting all terms and conditions of Mind The Gap / Sarah Knight Consultancy.
Mind The Gap / Sarah Knight Consultancy reserves the right to change any of the content, material, prices, offers or time period of the courses at any time. We advise you to read and accept the terms and conditions at the time of booking.
